Additional Points about the Terms and Conditions of this User Agreement

These terms and conditions and the agreement they create shall be governed by and interpreted according to the laws of the State of Massachusetts (without applying the State’s conflict-of-law principles). King Jewelers Inc. reserves the right to bring any civil action in Massachusetts, arising from your violation of the terms and conditions of this Agreement.

If any provision of this agreement is unlawful, void or unenforceable, it will not affect the validity and enforceability of any remaining provisions. King Jewelers Inc. may modify these terms and conditions, and the agreement they create, at any time, simply by updating this posting and without notice to you. This is the entire agreement regarding all the matters that have been discussed in the preceding paragraphs.

 

REWARDS CARDS TERMS AND CONDITIONS

The Rewards Program (“Program”) is offered at the sole discretion of King Jewelers Inc., hereinafter referred to as “King Jewelers”. At its sole discretion, King Jewelers has the right to modify, add or delete any of the Program rules, terms, conditions, benefits or Rewards (“Reward”), in whole or in part, at any time, with or without notice, even though such changes may affect the value of points already accumulated, the value of the Rewards and/or the time for redemption.

When you make purchases using your Rewards, you may earn bonus points subject to the Reward Terms. You will earn at least one dollar for every $20 of Qualified Purchases (defined below) made at King Jewelers. “Qualified Purchases” are merchandise purchases that are not discounted and also exclude sales tax, purchases made prior to enrollment, gift cards, returned merchandise, online services, service items, shipping, gift certificates and rewards redemption. If you return purchases on which you earned Reward points, those points will be deducted from your Rewards account.

Rewards can be redeemed for merchandise only at King Jewelers and may not be redeemed for gift cards, store credit, sales tax, prior purchases, or services including but not limited to shipping, or gift wrap. Rewards have no cash value and neither cash nor store credit will be paid for unused portions of the Reward. Rewards are not transferable and King Jewelers reserves the right to limit the time within which you may redeem Rewards. King Jewelers reserves the right to change the Rewards expiration date at any time without prior notification.

From time to time, we may extend Rewards enrollment offers to our customers to promote new Rewards program membership for non-members. Such enrollment offers are limited to new Rewards members. Existing Rewards members may not receive enrollment offers for enrolling in additional Rewards accounts. Accounts under the same name and address will automatically be combined.

 

King Jewelers reserves the right to provide Rewards benefits to some members based on geographic location, program participation, or information supplied by the member. Some of our special promotional offers, benefits, and communications also may be based on the volume or type of purchases.

The Program has no predetermined termination date and may continue until such time as King Jewelers, in our sole discretion, elect to designate a Program termination date. King Jewelers reserves the right to end the Program at any time without providing written notice to you.  Rewards don’t expire until such time as the entire program ends.

Abuse of the Program (for example, by failing to follow Program policies, allowing others to use your membership number or other improper conduct as determined by King Jewelers in our sole discretion) may result in termination of your membership and disqualify you from future Program participation.

Modification of these terms and conditions may only be made in writing by an authorized representative of King Jewelers. All interpretations of Program terms and conditions shall be at the sole discretion of King Jewelers and such interpretations are binding on you.

You are responsible for notifying King Jewelers of any changes of address, including your e-mail address. King Jewelers is not responsible for Rewards that are lost, delayed or misdirected in the mail or otherwise. Program points and Rewards may be subject to federal, state, or other taxes and such taxes are your sole responsibility.

Participants must be at least thirteen (13) years of age and must be a resident of the United States, which includes United States territories, or Canada. Participants must also provide a valid mailing address at the time of enrollment. An email address may be required for participation. Participation in the Program is void if prohibited by law in the jurisdiction in which the prospective participant resides. The Program is a United States program and is governed by United States law. The laws of the Commonwealth of Massachusetts apply to the Program and these Terms and Conditions without regard to any conflict of law rules that may require the application of the laws of another jurisdiction.
